Warranties

To the extent that the software licensed to you by our Licensors pursuant to the respective End User Licence Agreements comes with guarantees that cannot be excluded under the Australian Consumer Law you are entitled to (i) a replacement or refund for a major failure and, subject to the limitation below, compensation for any other reasonably foreseeable loss or damage (ii) you are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Those non-excluable guarantees are limited to in the case of goods/software to (a) the replacement of the goods/software or the supply of equivalent goods/software; (b) the repair of the goods/software; (c) the payment of the cost of replacing the goods/software or of acquiring equivalent goods/software; (d) the payment of the cost of having the goods/software repaired and in the case of services/software (a) the supplying of the services/software again; or (b) the payment of the cost of having the services/software supplied again.

Some products are licensed with additional warranties to those that you are entitled to at law. In relation to those warranties:

  2. to make a claim under those warranties you should email with details of the claim/fault;
  3. no expenses are payable in relation to such a claim other than as expressly provided in the respective End User Licence Agreement;
  4. the warranty period for such claims is that set out in the respective End User Licence Agreements.
